NOTICE OF PUBLIC HEARING FOR THE ADOPTION OF REGULATIONS FOR THE DEPARTMENT OF MOTOR VEHICLES

The Department of Motor Vehicles, Management Services and Programs Division, 555 Wright Way, Carson City, NV 89711, (775) 684-4778, is proposing the amendment of regulations pertaining to Chapter 483 of Nevada Administrative Code. Public hearings will be held at the following locations on the dates and times specified:

The purpose of the hearings is to receive comments from all interested persons regarding the adoption of regulations. If no person who is directly affected by the proposed action appears to request time to make an oral presentation, the Department of Motor Vehicles may proceed immediately to act upon any written submissions.

The proposed regulations amend Chapter 483 of the Nevada Administrative Code. Items will be discussed in the order listed:

  1. Revise regulations to reflect a photo fee for the issuance of an identification card after the voluntary surrender of a driver license due to confidential medical reasons.
     
  2. Clarify what documents are acceptable and unacceptable as proof of name and age for application for a driverís license, motorcycle driverís license or identification card.
     
  3. Identify the requirements for renewal by mail of an identification card.
     
  4. Revise regulation to require an applicant provide their full legal name upon application for renewal of their driverís license by mail.

There is a nominal economic effect of the regulation on the public for the cost of renewing and/or producing an identification card upon renewal or upon surrender of a driverís license to obtain an identification card.  There is no cost to the agency for enforcement of the proposed regulations.

The proposed amendment of regulations pertaining to Chapter 483 of the Nevada Administrative Code does not overlap or duplicate that of any other state or local governmental agency.  This regulation is not required pursuant to federal law, nor does the federal government regulate similar activities.

Persons wishing to comment upon the proposed action of the Department of Motor Vehicles may appear at the scheduled public hearing or may address their comments, data, views, or arguments, in written form to Debbie Wilson, Management Services and Programs, 555 Wright Way, Carson City, NV  89711.  Written submissions must be received by the Department of Motor Vehicles on or before September 19, 2003.  If no person who is directly affected by the proposed action appears to request time to make an oral presentation, the Department of Motor Vehicles may proceed immediately to act upon any written submissions.

A copy of this notice and the regulations to be amended will be on file at the Nevada State Library, 100 Stewart Street, Carson City, Nevada, for inspection by members of the public during business hours.  Additional copies of the notice and the regulations to be amended will be available at each office of the Department of Motor Vehicles listed, and at the main public libraries listed, for inspection and copying by members of the public during normal business hours. Copies of this notice and the proposed regulations will also be mailed to members of the public upon request.  A reasonable fee may be charged for copies if it is deemed necessary.

Upon adoption of any regulation, the agency, if requested to do so by an interested person, either before adoption or within 30 days thereafter, will issue a concise statement of the principal reasons for and against its adoption and incorporate therein its reason for overruling the consideration urged against its adoption.
